3.1 Consumers: Individuals seeking information about certified medical spas

3.2 MedSpa Owners/Applicants: Businesses applying for or maintaining certification

3.3 General Visitors: Anyone browsing the Site

4. SCOPE OF CERTIFICATION

4.1 What Certification Means: Our certification indicates that a medical spa has met our verification requirements at the time of certification, including:

• Licensed medical professionals
• Qualified medical director
• Legal ownership structure
• Use of FDA-approved products
• Emergency preparedness protocols

4.2 What Certification Does NOT Mean:

• Certification does not guarantee treatment outcomes or patient satisfaction
• Certification does not eliminate all medical risks associated with aesthetic procedures
• Certification does not constitute medical advice or endorsement of specific treatments
• We do not supervise day-to-day operations of certified medical spas
• Certification reflects compliance at time of review; ongoing compliance is the medspa's responsibility

5. LIMITATIONS OF LIABILITY AND DISCLAIMERS

5.1 No Medical Advice: The information on this Site is for informational and educational purposes only and does not constitute medical advice. We are not healthcare providers. Always consult with qualified healthcare professionals before undergoing any medical aesthetic procedure.

5.2 No Doctor-Patient Relationship: Use of this Site does not create any doctor-patient or professional relationship between you and MedSpa Board.

5.3 Consumer Disclaimer: While we verify certain credentials and compliance factors for certified medspas:

• We strongly encourage consumers to independently verify licenses and credentials
• We are not responsible for the quality of care, treatment outcomes, or any injuries, damages, or losses arising from services received at certified medspas
• Consumers should conduct their own due diligence before receiving any treatments
• The presence of a medspa in our directory does not constitute a recommendation or guarantee

5.4 Third-Party Verification: Our certification process relies on information provided by applicants and third-party sources (such as state licensing boards). While we make reasonable efforts to verify information, we cannot guarantee absolute accuracy of all information.

5.5 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDSPA BOARD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the Site
• Any reliance on certification status or information in our directory
• Any services received from certified or non-certified medspas
• Any errors or omissions in our verification process
• Any unauthorized access to or use of our servers

6. DIRECTORY LISTINGS

6.1 Directory information is provided by certified medspas and verified by us to the best of our ability.

6.2 Directory listings may be updated, modified, or removed at our discretion, including upon certification revocation.

6.3 Information in directory listings should be independently verified by consumers before making treatment decisions.

7. INTELLECTUAL PROPERTY

7.1 All content on the Site, including text, graphics, logos, and the MedSpa Board certification marks, are our property or the property of our licensors.

7.2 Certified medspas receive a limited license to use our certification marks as specified in their Certification Agreement.

7.3 Unauthorized use of our marks, content, or certification badges is strictly prohibited and may result in legal action.

8. USER CONDUCT

You agree not to:

• Provide false or misleading information
• Impersonate another person or entity
• Use the Site for any unlawful purpose
• Attempt to circumvent any security features
• Scrape, copy, or harvest information from the Site
• Interfere with the Site's operation
• Use our marks without authorization

9.3 SMS Terms & Conditions

• Program Description: MedSpa Board LLC provides SMS messages to communicate with patients and clients regarding appointment confirmations, rescheduling notifications, treatment follow-up instructions, and occasional promotional offers or spa updates.
• Message Frequency: Message frequency varies based on your interactions with us and your appointment schedule.
• Instructions to Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to our number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
• Instructions for Help: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at contact@medspaboard.com or 1-888-700-9997.
• Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
• Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.
• Age Restriction: You must be 18 years of age or older to participate in the MedSpa Board LLC mobile messaging program.

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of service of any third-party sites.

11. MODIFICATIONS TO TERMS

15. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any Certification Agreement (for certified medspas), constitute the entire agreement between you and MedSpa Board.
